This is an appeal from an order sustaining the defendants' plea in abatement. The plaintiff, Russell E. Borde, on July 9,
1962, was involved in an automobile collision with a car driven by the defendant, Olin Perry Hake. Borde, sometime prior to
the accident, secured collision insurance from the Heritage Mutual Insurance Company. The policy provided that, in the event
of loss occasioned by collision, Heritage Mutual would pay any damages in excess of $50. The defendant, Hake, prior to the
accident, secured a liability policy from the Preferred Risk Mutual Insurance Company. In the accident, Borde allegedly sustained personal injuries and also damage to his automobile. Subsequent to the accident
but prior to the commencement of this lawsuit, Borde made a claim for his property damage against his own collision insurer.
In accordance with the policy provisions, Borde was paid the amount of his damages in excess of $50 and he assigned his claim
to Heritage Mutual to the extent of the payment to him. No assignment was made of the $50 deductible not covered under the
policy.
